1. Acceptance of Terms

By using Aura AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Aura AI, operated by Andrew Snow.

You must be at least 18 years of age to use the Service. By using Aura AI, you represent and warrant that you are 18 or older.

2. Description of Service

Aura AI is a Discord bot that provides AI-powered image generation capabilities. The Service allows users to generate images using text prompts via slash commands within Discord servers. The Service operates on a virtual credit system, where users earn or are awarded credits that can be spent to generate images.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Virtual Credits

The Service uses "credits" as a virtual in-app currency. Credits are used exclusively within Aura AI to generate images. You acknowledge and agree that:

• Credits are a virtual in-app currency with no real-world monetary value.
• Credits cannot be exchanged, sold, transferred, purchased, redeemed for cash, or refunded under any circumstances.
• Credits exist solely to enable use of the image generation features within the Service.
• We reserve the right to adjust credit costs, earning rates, or credit balances at our sole discretion, including but not limited to granting, reducing, suspending, or revoking credits at any time and for any reason.
• Credits do not represent any property right, equity interest, or financial instrument.

4. Earning Credits via Third-Party Offers

Aura AI partners with third-party offer and survey providers, specifically CPX Research and BitLabs, to allow users to earn additional credits by completing surveys, promotional offers, or other tasks provided by these partners.

You acknowledge and agree that:

• Third-party offers are provided and controlled by CPX Research and BitLabs, not by Aura AI. We do not control the availability, content, duration, or reward amounts of any offers.
• Credits are granted only after the partner verifies successful completion of the offer. Verification is performed solely by the partner, and Aura AI has no control over the verification process or timeline.
• If a partner reverses, charges back, or flags an offer completion as fraudulent, the corresponding credits will be removed from your account, even if they were previously credited.
• Aura AI is not responsible for any issues, disputes, or experiences you encounter while interacting with third-party offer or survey platforms. Any complaints regarding a specific offer should be directed to the relevant partner.

5. Prohibited Conduct

When using Aura AI, you agree NOT to engage in any of the following activities:

• Fraud and Offer Manipulation: Engaging in fraud, deception, or any form of manipulation of the offer or survey systems to earn credits dishonestly.
• Multiple Accounts: Creating, operating, or using more than one Aura AI account. Each user is limited to one account.
• VPN and Proxy Abuse: Using VPNs, proxies, VPS services, emulators, or other tools to mask your identity, location, or device when completing offers or interacting with the Service.
• Automation: Using bots, scripts, macros, auto-clickers, or any automated tools or methods to complete offers, earn credits, or interact with the Service in any automated manner.
• Gaming the System: Any attempt to exploit, cheat, game, or otherwise abuse the rewards system, credit system, or any other aspect of the Service.
• Illegal Content: Using the Service to generate images that are illegal, harmful, threatening, abusive, defamatory, or that violate any applicable law or the rights of any third party.
• Interference: Interfering with or disrupting the Service, servers, or networks connected to the Service.

6. Account Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for suspension or termination may include, but are not limited to:

• Violation of these Terms of Service.
• Engaging in fraudulent or abusive behavior.
• Suspicious or unauthorized activity on your account.
• Requests from law enforcement or legal obligations.

Upon termination, your credits will be forfeited and will not be refunded, compensated, or transferred.

7. Disclaimers

THE SERVICE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the use of the Service will be accurate or reliable.
• The quality of any content or images generated will meet your expectations.
• Any errors or defects in the Service will be corrected.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AURA AI AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

9. Indemnification

You agree to defend, indemnify, and hold harmless Aura AI, its operators, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or inability to use the Service.
• Your violation of these Terms of Service.
• Your violation of any applicable law or the rights of any third party.
• Any content you generate or share using the Service.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in New Zealand, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We reserve the right to modify or update these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through in-bot notifications or other reasonable means.

Your continued use of Aura AI after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service immediately.
